Haytham Faraj Wins Full Acquittal in Sexual Assault Case

 

News Release:  Haytham Faraj, one of the founding partners of the Law Firm of Puckett and Faraj, has won a complete acquittal of an Army Specialist accused of rape at Fort Irwin, CA.  The three-day court-martial ended when the military judge found our client “Not Guilty” after a trial during which the accuser refused to answer many questions in the courtroom.   

 

This is yet another case of the Department of Defense’s over-zealous pursuit of an accusation of rape without first examining all the evidence and realizing the claim was false.  Certainly, unit commanders must take every accusation seriously and should investigate to determine if there is probable cause to send the case into the military justice system.  Once in the military justice system, an Article 32 report either recommends that there is probable cause, the charges should be changed or it should be dismissed and not go to a court-martial.  It is the prosecutors’ and senior judge advocates’ duty, based on the Article 32 investigating officer’s recommendation, to advise the commander whether or not the allegation is substantiated by reliable evidence and whether or not it should be sent to a court-martial.   

 

In this case, the commander ignored the advice of the Article 32 Hearing report that recommended dismissal of the charges and sent the case to a court-martial.  When an Article 32 report provides such a strong recommendation for acquittal and the command sends it to a court-martial, an experienced military criminal defense attorney, like Haytham Faraj, can in short order, win an full acquittal.

This looks great Marcy. I can't edit because my computer died. The only thing I would change is the language about the advice from the SJA. While it's probably true, I have no evidence to corroborate that. The commander did however ignore the advice of The 32 officer that the charges be dropped.
