No.  He was not.  Sorry for tardy reply.  As to Babu, I always thought we had then zen master of all things appellate in His Eminence, Col Sullivan.  I'm willing to discuss this more, but I'm much more inclined to ask Col Sullivan to argue, given his status with the Court.  That would be my preference.

Was SSgt Wuterich present at the ex parte hearing?  The list of those present on page 1 of the MFR doesn't include him.  It would potentially create an appellate issue if he wasn't there.
