RE: US v. Scarselli: 3rd UCI motion by the Defense



All,

Looking at the long-range docket I see that there are a couple of 29 Palms cases going the week of 15 Nov (Alston GP on 16 Nov and the contested Mattison SPCM 17-19 Nov).  This may present a courtroom availability issue and require the Scarselli motion to be litigated at Camp Pen if the motion is going to be litigated the week of 15 Nov.  

Does the 22-24 Nov timeframe work better for you?  I am flexible.

I have a 39a on 15 November in US v. Egnash.  I'm clear 16 and 17 November.  18 and 19 November, the Chief Defense Counsel of the Marine Corps has asked that all MCRD DCs be available to meet with him.

It appears that the government will need at least a week to look into the latest four allegations of UCI and respond.  The defense has further requested the production of witnesses who are scattered between Okinawa and Kentucky and did not provide any contact information for these individuals.  It will likely take the rest of the week to determine their availability, especially considering that two if not three of the individuals are civilians who were fired for misconduct, and may not have either local addresses or have left forwarding information.  It should be possible to have responses to the court by 10 Nov. 2010.
