Wuterich update



Mr. Kruger,
Received your voice mail this morning.  Frank is in town (DC) today, and stuck in the weather, or he would be homeward-bound to California.  We are preparing to file a motion alleging unlawful command influence in his case.  We are asking that his charges be dismissed on those grounds.  We have a fairly good chance of success as a similar motion was granted (and affirmed on appeal) in the case of his battalion commander, LtCol Chessani.  The hearings on that motion will occur during the week of 22 March 2010 at Camp Pendleton.  I'm sure there will be media coverage of those hearings.
We're neck deep in snow here.  All public transportation is shut down and few cars are braving the roads.  I'm working from home today and catching up on my other cases.  One of those cases involves SO2 Matthew McCabe, one of the three Navy SEALs facing court-martial for punching an infamous Iraqi insurgent in the gut.  You may have caught it in the news.
