RDO Street Lights Questions



Counsel Members, RDO Management & Neighbors,

 

I’ve read many emails being circulated lately regarding our street lights and it seams like our greatest frustration, is the lack of facts and un-bias information.  We’ve heard assurances that “that this is a priority”, but have seen little evidence.  It appears the only action being taken, is the bases for the old light fixtures are being covered-up with concrete, so we naturally assume the worse.

 

I thought I'd take a couple of minutes and see if our esteemed counsel members and/or association can help us better understand the facts, with a few simple questions:

It is my understanding that the Master Builder and RDOHOA processed an easement with the City, which allows the RDO HOA’s landscape contractor access to maintain the landscape within the City's right-of-way (parkway’s and medians).  In similar master planned communities throughout Southern California, the easement language will specifically include lighting (if the Builder/ HOA agreed to maintain the street lights).  

 

1.                    Does this easement language include maintenance & replacement of the street lights?

2.                   Who has been changing the lamps for the past 25+ years?

 

Typically when a new master planned community is being set-up, a Community facilities District (CFD) is established.  This is a tax revenue that is allocated for repair and replacement of improvements within the City’s right-of-way.  This CFD would be for amenities specifically in RDO.  If there is a RDO CFD (or something similar), we would have been paying taxes from the get-go and monies would be available now to solve the problem.  If this was never thought about 25 years ago, then City obviously has no money allocated for replacement and it’s very understandable, why we see no progress.

 

3.         So which is it:  Does a portion of our taxes specifically go to maintaining exclusively RDO public facilities? Or not? 

4.         If so, what unique RDO facilities is this money being allocated for? And what’s the problem?

5.         If not… ouch!!!! 

6.         I believe the exact same (or a very similar) fixture was installed at the new Rancho del Oro Road Sprinter station.  If the City doesn’t like and accept the responsibility for this type of fixture in RDO, why is their use continued in this location?  

 

Last but not least, the RDO Associations has indicated that the City is deferring responsibility (based on an agreement between the master Builder and/or HOA sometime in the late 80’s).  Although they forwarded a link, I can’t find any reference.

 

7.         Can some one please clarify this?

 

If I have misspoken or misrepresented any information, please let me know and I’ll retract.  In addition, if by writing this email, it means that the dudes that semi-annually egg the neighborhood cars increase the frequency of their egg’n… I retract everything!  Otherwise, it would be greatly appreciated if the resident’s can get a better understanding of the topics and questions listed above.
