Haytham--At this point it's not enough for Mr. Dodd to agree to return the money. We also need a commitment from him as to when that will happen. While you're working on that, I'll discuss the release with Brian. Thanks. Bert

Mr. Tabor,

I am pasting below a paragraph that I request Mr. Savino agree to.  I leave it to your discretion whether you would like to modify it so that you can secure Mr. Savino’s consent.  Mr. Dodd has agreed to the language and to refund the $150,000.

 

“3D Global Solution and Mr. Michael Dodd on the one hand and Mr. Brian Savino and on the other hand hereby mutually release each other, and their respective agents, attorneys, employees, officers, and directors, principals and assigns from any and all claims, demands, causes of action, rights of  action or other antagonistic assertions of right, known or unknown, from the beginning of the world until the present, related in any way to the parties’ business dealings or the transaction between the parties as set forth in the letter between the parties dated July 14, 2011â€?Good Faith Funding towards 3DGS equity purchaseâ€? and as set forth in the “Preliminary memorandum of termsâ€? to purchase equity in 3DGS.â€?
