| Presented by Dean Webb, Esq.âRICO Aiding and Abetting: A Multi Faceted Edged Sword for Litigation of RICO Claimsâ, introduces attorneys representing business and commercial clients that find themselves victims of fraudulent practices to practical and instructive legal analysis in assessing the potential joinder of individuals and entities that did not play a direct role in their clientsâ financial demise, but were engaged in conduct that aided and abetted those principal actors. The material presented sets forth analysis as to how an attorney can bolster a clientâs case by advancing a RICO aiding and abetting claim, advancing a RICO conspiracy claim to aid and abet a RICO substantive violation, advancing RICO aiding and abetting of a RICO conspiracy claim, and, for purposes of enhancing the allegation of committed predicate acts, advancing as independent forms of âracketeering activityâ aiding and abetting of those specifically identified form of statutorily listed federal offenses.
The course will include a review of federal case law that both recognizes and rejects RICO civil aiding and abetting liability of RICO substantive offenses, as well as note the patent absence of Supreme Court decisionals on the issue.
