Gov't wants to reopen Burke 32 in light of Fosler



Ranae,
Just got a call from Capt Harris.  Asking about my availability to do an Art 32 BEFORE our scheduled trial date.  Did he contact you?  Says because of Fosler they want to deal with the Art 134 offense (leaving the scene of an accident) at a 32.  Do they have to do that simply because they didn't originally refer the terminal element?  We're pre-arraignment, aren't we, or are we?
