Counsel,

When either party requests an 802 conference, the Court will grant one.  The government has just asked for one.  

Therefore, Major Gannon, please arrange for a time with the defense when we can talk on the phone again.  It seems that early morning for me and late evening for you has worked well in the past.  My schedule next week is a contested case Tuesday through Friday.  I can be available, for example, at 0730 on Tuesday morning, my time, as I will start Court at 0830.  That would be Monday evening your time.  Perhaps that will work.  Just let me know.
