Did you notice that Maksym changed what Jones did? Jones said there was CONTINUOUS REPRESENTATION. Maksym said Jones wasn't clearly erroneous because there wasn't a PERMANENT BREAK. SO it's not wrong to say there was NO break because there wasn't a permanent break? What bullshit.

We need to get this in front of CAAF ASAP while Chief Judge Effron is still there. I'm supposed to leave for the USDB on Sunday afternoon. Unless my power is knocked out by a hurricane, I'm optimistic that I can punch out a draft writ appeal on Saturday night/Sunday morning. Hopefully one of you can then get it in shape to get over the finish line. But it's much, much more important to file fast than to have it be perfect.
