What Judges Should Know About Administrative Hearings and DWI Courts

What are the nuts and bolts of a license suspension administrative hearing? Listen to the essential due process elements of an administrative hearing. With a focus on driver?s license reinstatement hearings, this presentation will examine those essential elements, including the notice of hearing, the hearing?s structure, the type of evidence used, such as hearsay and officially noticed evidence, the examination of the petitioner, the importance of rulemaking in the hearing process, and the deliberative process. Emphasis will be placed on the information or evidence needed from petitioners whose driving privileges were revoked for driving under the influence, and how to effectively examine these petitioners in order to make a fair and just decision while also protecting the public safety and welfare.

What is a DWI Court? These specialized criminal court dockets are spreading rapidly with nearly 600 now in operation or in the planning stages. How do they work? How can a DWI Court help a Judge that has to deal with a docket of repeat drunk drivers? How do they reduce DWI recidivism and increase public safety? How can a court establish such a program using existing staff and be cost effective for the locality? Our presenter is Judge Harvey J. Hoffman, ABA/NHTSA Judicial Fellow and the nation?s longest serving DWI Court Judge.
