Neal and I spoke this morning.  It looks like the 20-day deadline for filing a writ of mandamus challenging Jones' denial is 9 June.  I think it's probably best if we file by 6 June, especially if Jones produces an authenticated transcript of the hearing today or tomorrow.  (To the best of my knowledge, he's already provided an authenticated transcript of the ex parte hearing to Mr. Troidl but hasn't yet authenticated the 160-page transcript of the Article 39(a) session.  Is that correct?)
 
Any thoughts on timing?
 
Of course, the government must be sweating bullets right now wondering whether to pay to fly everyone in when the hearing may not occur as scheduled in the stay is in place.  Should we be approaching the government to ask to file a joint motion with NMCCA to scrap the 27 June (IIRC) hearing date?

  On 27 May 11, the NMCCA took action in the subject case.  They: (1) Ordered a stay in the court-martial until further order of the court; (2) Ordered the Gov't to produce on or before 13 June 2011 an authenticated verbatim transcript of all the court-martial proceedings following the CAAF 4 April 2011 order; and (3) ordered the military judge to produce on or before 13 June 11 his FoF and CoL supporting the denial of the motion to abate.
