RE: U.S. v. Lopez; motion for a continuance of the trial date



Good Afternoon Sir, 

The government and defense have had a meeting of the minds and both concur that the current trial dates of 31 May are not feasible based upon the reasons stated in the defense motion. The earliest feasible date that is mutually agreed upon and which civilian counsel has availability is 3 August.

No need for an 802 until you get with TC and see what alternative dates would work ...well in advance of August...for trial.

I am NOT inclined to grant such delay...second defense delay...until such a late date.

Discuss with opposing counsel and then we can talk if need be.

I'm in trial today but should be available anytime tomorrow if needed.

In the absence of a mutually agreed upon date certain, the defense request for a second continuance is DENIED.

All parties should be prepared to proceed with trial 31 May - 3 June.
