Re: Australian Defence Forces - Civilian casualties in AFG 2009

Hello Haytham,

many thanks for your note.  The course sounds terrific but sadly we probably would not have time to fit it in!

Not sure if I mentioned but our trial is due to start on 11 July 11.  I'm in the process of making an application to vacate that date to give us a little more time to prepare.  Consequently not sure at this stage whether we will get to the US on the dates I foreshadowed and it may be pushed back by a couple of weeks.

Is your Wuterich matter still getting under way at the end of June?

Kind regards

Hello Jonathon,
I will be in Wyoming staffing the Death Penalty Course at the Trial Lawyers College that week.  I will not be available until the following weekend.  I am thinking that you and David should attend the course.  I hadn’t thought about telling you about it because you’re in Australia.  Last year the Major Nidal Hassan defense team attended, among other defense teams with high profile cases.

When I defended the Hamadania war crimes case which was initially going Capital, I was a student at the course.  Your client doesn’t have to be facing capital punishment to go. I cannot say enough about this course.  I will of be there the entire time.  We can discuss all facets of defending this type of case.  Also available to you will be Joseph Low who defended a co-accused in the Hamdaniya case.  We were the only two to get acquittals on the 1st degree murder charges.  Joseph also represented a Marine if a 1st degree murder case out of Fallujah.

Cyndy Short, the course director, is one of the most skilled death penalty defenders and attorneys I have ever met.  Cyndy and Joseph will be there as well as mitigation specialists, mental health professionals and psychodramatists.  You will have some fantastic resources in people and methods for the entire week.  The course is nearly full.  Let me know if you have any interest. You may have to expand your trip for a few days to complete all you need to do but I assure you it will be worth it.  I’m including a link below.  I have also cc’d the course director should you have questions.

I look forward to meeting you

Best,
Haytham

Good afternoon Haytham,

David McLure, a colleague of mine and co counsel, has passed me your contact details.   I understand that you are on the defence team for SSGT Wuterich trial.

I'm a major in the Australian Legal Corps and am acting for a commando charged with 5 counts of manslaughter and 2 counts of dangerous conduct.  David and I intend to be in the US in the week beginning Monday 13 June 11 and wanted to know whether you would be able to meet with us at some stage that week?  We would very much like to pick your brains on a number of matters if that were at all possible.

Just to let you know that I have made contact with Edward the CQB expert and intend to meet up with him as well in that same week.  The contact you provided is very much appreciated.

I look forward to hearing from you.

Kind regards
