FYI, if you didn't already know LtCol Rubin is going to be the Pacific Regional Defense Counsel.

Ted,
Here's the latest. After interviewing a few witnesses, reviewing the evidence and extensive discussions with Jim and Adam, I have decided to ask for about 20 witnesses. The reasoning behind my decision is that this will be the only opportunity we have to talk to relevant witnesses, many of whom say they saw nothing or will testify that they were pressured to say what they did in statements. I recognize that my decision may cause some damaging evidence to come out which would help the government make their case. That's a risk in every case and a risk that is outweighed by the necessity to hear from all witnesses that the government may call at a trial against you. The notion that the government wants to kill this is unpersuasive. If they want to kill it they can withdraw the charges. They obviously have chosen not to do that.

Your hearing has been rescheduled to April 19. I am not sure why that happened. That's a matter that will be addressed at the hearing itself. We have a change in investigating officers. Our new IO is LtCol Rubin. He is a military judge that I believe is fair and I respect.
