Fee Arrangements

All –

As you know, I’ve been trying to refer as much business as I can to your firm, primarily in a co-counsel capacity. We need to discuss a generic arrangement of fee splitting when I remain on a case. If I refer something to you outright where I will have no involvement, it is completely yours to keep. And no doubt I will do that often as well.

But given our mutual preference is to work together as much as possible and we all want to derive some profit from the arrangement, we need to come to terms with how best to accomplish this depending on the case. There are a variety of ways to do this which are customary. Often times it is a percentage of the fees you charge. At least that is how I have dealt with it in the past with other firms.

Of course, no matter what the arrangement is it must be disclosed to the client in writing.

I will be swinging by your office today to meet with Debra to drop off some documents. I won’t have a lot of time as I am flying to NY in the evening but if anyone is around, we can start discussing this.

Thanks!

Mark
