As Neal pointed out before, our brief is due on Monday. I had hoped to have it ready to file tomorrow, but that's not going to happen for two reasons: (1) I had no power last night and my Comcast wi-fi was down for my laptop; and (2) it sure would be nice to have access to the sealed docs before we file our brief, so filing on Monday gives us a little more time for CAAF to let us see the sealed exhibits. If we have to file before we see them, we'll drop a footnote saying we may move to supplement our bried if CAAF grants our motion for access to the sealed exhibits.
Unfortunately, I'm leaving early Monday morning to fly to MCAS Miramar for Reserve duty. Maj Sip, will you be in on Monday? If so, can you take care of the actual filing? If not, I'll go into the office Sunday evening and file. (If Maj Sip can do that, I'll circulate a draft from home NLT Sunday evening.)
