I need some of your brainpower - I have a client who was sent to a mandatory psych eval by the Pentagon Police Force. Once he arrived, the doctor informed him that he was also ordered to withdraw 6 vials of blood for testing everything from drugs, STDs, sickle cell, etc. Client filed a FTCA claim, which has been recommended for denial because the issues overlap with his EEO claim. Are there other causes of action we can bring? I know this can be an ADA violation, but that's not going to yield anymore in damages than the existing race discrim claim, so I'll bring it, but I'm looking for something where we can attach some real damages. |
