Since I told Mr. DeCicco that I was literally about to hit the send button to file a motion for leave to file a supplemental brief and he told me not to, I can't believe that he wouldn't give me a heads up if the info he gave me on Friday changed.

No clue.  I expect it ought to come out soon, however.  I'm a bit unsure as to why he's interested in starting.  Regardless of what NMCCA said, the CAAF appeared intent on making its own decision.  It ordered that the NMCCA make findings and return the case to them--not that the NMCCA should simply make findings.  In other words, even without more briefing CAAF was not done with the case.  The order directs the NMCCA to make the relevant findings then "return the case to [CAAF]."  The NMCCA made its directed findings and now the case is with CAAF for a decision.  You might want to point that out to the judge if he insists on going forward.
