More delay



Frank,
Today NMCCA issued its opinion and got it to CAAF.  It ruled the same way as before and was again wrong.  But the CAAF clerk of court notified Col Sullivan that on Monday, CAAF is going to issue a briefing schedule, meaning it wants the parties to fully litigate (on paper) the entire Hutchins issue as it applies to Vokey in your case.  It goes like this:  As of Mon (10 Jan), the parties will have 20 days to file their briefs, then 10 days to answer each other, then another 5 days to rebut.  Then CAAF takes the matter under consideration for as long as they want.  If you do the math, that puts the process well past 24 Jan.  We'll probably formally move it off that date early next week.  Just wanted to give you a heads up today because today is when we found all this out.  It's crazy.  No one anticipated it.  Everyone thought CAAF would figure it out before the trial date, but we have gotten their attention (in a good way) and it may all work out to our benefit.  That's really all I know
