China's growth has been phenomenal, and even in these challenging times it continues to grow rapidly. A major new development is the emergence of a middle class in China which is increasingly looking to western products and services. U.S. franchisors and retailers have been at the forefront of expansion into China. A number of franchisors, whether through corporate outlets or franchised outlets, have created substantial networks. All of the indicators suggest that the appetite of consumers in China for Western brands will grow.
Nevertheless, China does represent challenges to those wishing to take advantage of these opportunities. The procedures for obtaining necessary consents and registrations are not always clear. There are uncertainties relating to the enforceability of trademark rights and commercial agreements as well as the numerous political, religious, cultural, and business obstacles that have to be overcome.
This program will provide participants with valuable insights from U.S. and Chinese attorneys, all with extensive experience in structuring, negotiating, and managing transactions in China as well as dealing with issues when things "go wrong." The speakers will focus on both legal and practical issues so as to enable U.S. practitioners to be aware of the issues to be addressed when their clients expand into China. Participants will receive program materials addressing the issues in greater depth.
The program is designed to be a free flowing discussion and will include a question and answer session for which audience participation is encouraged.
