Statement IRT Report of NJP



Gentlemen, today I must submit a statement (or a statement stating I wish to make no statement...lol) simply in response to the report of NJP.  I have drafted the below...can you take a quick look at it and send me any changes/comments please.  Ask that you get to it soonest as it is due today.  Note I took advantage of this opportunity to try to influence the BOI decision...but unsure I should and if I should maybe what I wrote and the way I wrote it is not the best approach...so...let me know and please don't hold back. Subj:  STATEMENT IN REFERENCE TO REPORT OF NONJUDICIAL PUNISHMENT FOR 
       INCLUSION IN OFFICIAL MILITARY PERSONNEL FILE (OMPF)

Ref:   (a) CG ltr 1920 SJA of 10 Dec 10 (Ack of Report of NJP)

1.  Per reference (a) I am submitting this statement for inclusion into my OMPF.    

2.  I received the subject report of NJP on 8 Dec 10 and it accurately captures the chronology of those proceedings.  In that regard I have nothing to add.  In response to the recommendation that I show cause at a Board of Inquiry, I ask that the appropriate authorities consider the following when making their decision/recommendation: the nature of the specific events; the absence of malice and misconduct therein; and that thus far, in addition to the NJP and letter of reprimand in my OMPF, I have also been relieved for cause, will receive adverse fitness report(s), will likely lose my Lieutenant Colonel selection, will have paid $13K in legal fees, and will lose the difference between Lieutenant Colonel (or Colonel) retirement versus Major's retirement.  ***I wanted to put a reference in here about the punishment commensurate to the offense.***

3.  The Corps has been my life for nearly 17 years.  I have served honorably and faithfully in combat and garrison.  While under my charge the Provost Marshal's Office on MCAGCC, Twentynine Palms did not fail at any assigned mission and for the past 16 months, since my relief, as I've gone through the legal process, I have remained motivated, productive and devoted to Corps and country; as attested to by my superior officers in charge.  As indicated by my record and letters submitted at the NJP I have had a positive impact on the lives of countless Marines and on the success of many critical missions.  I can and will continue to make significant contributions to the Corps in any billet assigned; in combat or garrison; in or out of my MOS community.
