Gentlemen,

Capt Hur and I will be in 29 Palms this evening, tomorrow, and possible Thursday.  I request that we all meet to discuss alternative dispositions to this case.  Maj Miner and I had a good conversation about a week ago about this case that I think was very productive.  We bridged a good portion of the gap between the defense and government.  I'd like to see if we can achieve an agreement on a settlement since we will all be available.

 

Here's where I think we're at:  Defense and Prosecution can probably agree to the forum for the alternative disposition.  Where we still have space to close is what charges must be pled to.  I propose that we both come with proposals for what charges we want.  I'd like this to be an open and honest discussion of the evidence.  This case has gone on so long that no one will be giving anything away by discussing their respective cases.  I propose we use Maj Munoz as a mediator if he feels that he can be a neutral arbiter of the facts in this case.  If he has been involved in the case, then I propose we use another field grade JA who is available.  I'm even thinking that we could use a military judge if the judiciary would agree to assist.  

 

Please let me know your availability.  I recognize that we may be straining your schedules but I think it may be worth it because the couple of hours invested this week may save us a 2 week trial.
