Brito SCM Gentlemen, I'm informed that Sgt Brito was told his summary court martial has been scheduled for 10 November. We ask that the SCM go 15 November please. He wants to have his civilian attorney present per RCM 1301. Haytham Faraj, ret., a civilian attorney and former Marine judge advocate of Sgt Brito's wants to be present for Sgt Brito's summary court martial. Given that this case has been going on since December 2008, I think a delay of 5 days is very reasonable. This is especially true in light of the fact that there are numerous active duty and reserve judge advocates in the local area that are willing or able to be SCM officers on 15 November. Christian P.
