Herb –

 

As I mentioned, I did reach out to Clyde Slick last week.  I was out of the country last week and he is out this week.  He responded to me and we are planning to talk next week when he returns. My sense is that we are both still committed to finding some business solution – it has been scheduling difficulties rather than a lack of intent that have caused the slow progress.  I’m glad to see that Mike Dodd is still looking for a better answer.

 

I’ll update you after I talk with Clyde next week.

Mr. Dodd has responded in the affirmative.  His focus is on accomplishing what we agreed to during our last session. To that end he is open to suggestions on how to proceed.

As I have previously indicated, the ADR Office at the Court would like to close out the mediation in this case unless the parties are actively continuing to use the process.  Based on my conversation with Mr. Faraj, and my most recent email with Mr. Rosenblum, I understand that the parties are still interested in a negotiated resolution, but that little  or no progress has been made since our last session.  I am willing to do whatever I can to assist, but I cannot do anything unless both parties agree to make use of my services.

 

So that I can advise the ADR Office, I would appreciate your conferring with each other and letting me know by the end of the week how you would like to proceed.  My understanding is that even if the mediation is closed out now, it can be re-opened later if the parties jointly request.
