RE: Art 32 Continuance

Maj Keske,

I believe you meant to cc all parties, but I appear to have been the only recipient of the below email. Everyone is cc-ed on this email.

I don't have a problem with any continuance, including one until 9 January, as long as we have documentation to the effect that the defense agrees that the entire period of continuance is attributable to the defense for speedy trial purposes. With the accused in the brig, I need formalized paperwork, which the defense has not provided.

If the continuance is only for a period of 35 days, I am unavailable the week of 15 November. I will be available the following week.

Any objection from the Government to my granting a 35 day continuance on the Bell case? Inclusive dates would be 12 Oct to 15 Nov (to clear the Veterans Day 96), with the Art 32 rescheduled for 16 Nov? Based on Mr. Faraj's letter, the days would be excludable for speedy trial/Art 10.
If Defense needs additional time they can ask for it then, unless the Government does not object to the 90 day request, in which case it would be from 12 Oct to 9 Jan, with the 32 starting on the 10th.
