Mr. Faraj,
Based on my exchange with IC1 Wofford today, she is a high risk of busting providency even at a summary. I know Victor Kelly said that it is his belief that civilian counsel can represent clients at summaries without it becoming a federal conviction. I think she might need someone there whispering in her ear. Just a thought.

Hi Nikkia,

Here's the latest version of the PTA.  Here are the changes they are asking for:

1.       Not processing you for administrative separation will be suspended for six months than disapproved (call me to discuss what this means)

2.       A stipulation of fact.  This basically means you admit to all the charges you're pleading guilty to in writing.

 

LCDR Clady keeps complaining to me that you're not showing up to work on time or that you're not in the appropriate uniform.  I know you're feeling stressed and have a lot going on in your life but I need you to try and focus on doing what you need to so they stop complaining about you.  I have no reservations about representing you at a court-martial but I don't want to do it with a UA charge or some orders violation of being out of uniform.  A special court-martial conviction will be very difficult on your career and will put you in a situation where you have to fight an administrative separation.  The decision is 100% yours.  I think this is a good deal because it allows you to move on with little damage and no future risk.  If you want to fight at a court-martial, we can do that but you have to make sure you don't give them any opportunity to complain about your performance of professionalism.  I still recommend this deal!
