I am currently out of my office on training.  based upon my review of the e-mails regarding the availability of witnesses, it does not appear that we need to hold a further telephonic 802.  Accordingly, we will sort this out and place it on the record on Monday.

Sir,

The defense has requested AVCM Spaddy to appear in person as a character witness.  While trying to make travel arrangements for AVCM Spaddy she informed my staff that she is currently TAD to Millington and sitting on a selection board until 7 May 2010.  She has informed me that she will be available to testify telephonically if we give her a time frame for the call.  Due to her operational commitment, the Government does not object to her telephonic testimony. 

Trial Counsel is available today and tomorrow for an 802 to discuss this matter.
