RE: US v. Wacker: trial (expert toxicologist testimony)



Sir,

I would plan on 28 February to 4 March for trial in this case.  Thank you so much for your past help and future anticipated assistance.  I envision you listening to the testimony of Ms. Brooder and Easley-Cook and other witnesses and then commenting on the plausibility of those scenarios given alcohol consumption.  The 32 report is attached with summations of testimonies for your orientation.  Current charge sheet is also attached.

Thank you Sir for sending that.

As usual with these things, testimony is going slower than expected.  I
don't think it will go today.  Possibly Wednesday afternoon.  We've only
done 1.5 witnesses so far (finished Jessica Brooder yesterday and are only
half way through Easley).

I'll give you advance notice tomorrow Sir if we don't just rely on your
opinion.

Thank you Sir.  I've attached the charge sheet and some statements.  The
main victims are:  Elizabeth Easley and Jessica Brooder, who claim they were
raped in New Orleans.  Also, Nicole Cusack is a victim who claims that on
their first date Capt Wacker had sex with her while she was blacked out.
She then went on to have a 5 month boyfriend/girlfriend relationship with
Capt Wacker.  She only came forward with accusations when she learned about
Easley and Brooder.  

Also, the Article 32 in this case has been changed until 12 to 13 April.
I'll let you know more as I learn it.  Thanks again for agreeing to help us
as a consultant.  As before, all matters we discuss are confidential and
subject to the attorney client agreement I have with Capt Wacker, the
client.
