Mr. Keller,

At 0800 PST today, I spoke with LtCol Jones regarding the NMCCA order dated 29 December 2010.  During our conversation, we went through the exhibit list maintained by the court reporters.  LtCol Jones identified Appellate Exhibits 94, 97, 99, and 101 as exhibits that he considered before finding that good cause existed to sever the attorney-client relationship in the case.  Per his request, I scanned the exhibits and have attached them to this e-mail.  Due to the size of the files, pages 1-90 of AE 94 will be sent in a separate e-mail.  Please let me know if you have any questions.

Capt Dempsey,

See the attached for the latest request from NMCCA.  They want exhibits I may have looked at in ruling on the ex parte issue and severing the attorney client relationship.  I don't have the originals.  I know I looked at, at a minimum: 1) the declaration of Mr. Puckett from 8/28/2008; the page from the law firm of Fitzpatrick, Hagood, Smith, and Uhl regarding Mr. Vokey's biography; 3) the proffer of Colby Vokey.  I am not sure what else they need, but they need it today, 3 January.  So, I need to talk through the Appellate Exhibits with SSgt Myers, or someone, to make sure you get up there what is relevant.  (I don't have my sheet of the number of exhibits either, as I left that at Pendleton.  

I will try to call late tonight, my time, or early in the morning.  I assume SSgt Myers would be the best person for me to talk to, if she is around.  I need her phone number, yours, etc., so that we can get these appellate exhibits scanned and emailed to NMCCA.
