Haytham has one condition and I know that you will have no problem accepting its terms, he asked me for the same promise with the multitude of things I learned from him in trial prep for my case. Haytham: "You may share whatever you like. I have one condition, that nothing I share, either advice or work product, ever be used to assist the government and that he never use any of that if he ever becomes a prosecutor. Send me his email. I'd like to congratulate him." In the end I think your skills will be better on the Defense side; you already know how to think like a prosecutor, I'm sure that you are going to have an extremely successful tour in your new billet. I withheld making these allegations until I could have the subject officer and other witnesses on the stand, under oath, to best evaluate the facts. I strongly recommend you review the transcripts from the 39a in the case of U.S. v. Wacker held on 22- 24 February and 11 March 2011 and the judge?s findings on the UCI issue as they provide a more complete record of the facts. I could not provide them to you as I do not have them yet but have asked that they be produced. I bring these charges with a heavy heart because it is never comfortable to accuse an officer of wrongdoing. My reservations regarding these allegations is but further proof of the seriousness with which I take these charges and the facts underlying them in this case and in others that you probably have some awareness of based on coverage by the Marine Corps Times.
