I am in trial this week so my answers are going to have to be brief.  If you wish we can set up a time to talk.  If you want to know the exact rule that governs the upcoming proceeding, google “Rule for Court-Martial 405.”  It will tell you what the hearing is about, what his rights are and what rules will govern this particular “preliminary” proceeding.

Hi Haytham,

Thanks for your reply this is great. Can you outline for me the following:

1) what you do know about the case.  I have followed it in the news and have reviewed the charges is detail.

2) Specifics that you are aware of regarding your review of court documents.  He has been charged under the Uniform Code of Military Justice for violating orders and under the what’s called the Assimilated Crimes Act which allows the military to charge military personnel, in some case, with violations of Federal law.  Based on my calculations he is facing around 240 years in prison

3) a bit about the process of his trial.  He is not going to trial.  He is going to a preliminary hearing to determine whether there is probable cause to establish that an offense was in fact committed and that he actually committed it.

4) The fairness of his trial in your opinion and expertise of military law especially in regard to the more serious charges against him.  We have to talk about this.  It’s more complicated than I have time to explain in an email at this time.

If you could do this via email this would be great. Also let me know how you would prefer to be identified if I quote you directly and if this is ok with you? You can quote me as Attorney Haytham Faraj, former senior U.S. marine Corps defense counsel.

Thank you for your response. If you can answer a few questions about the case this would be great. Before I send you questions I just need to know in what ways you are familiar with the case. So I know what questions you could best answer.

Has the BBC interview been released? Is their a link to this?

I'm also trying to reach someone within the Manning family or the defense council? If you can be of help in this regard I would greatly appreciate this.

As well if you have any other recommendations for people involved that I have not mentioned? Thanks again for your help.
