U.S. v. Rowe continuance



Good afternoon your honor,
I am writing to inform you that the defense will be requesting a continuance
of the trial scheduled to begin next week.  As you may recall during the
arraignment of Capt Rowe, my co-counsel and Capt Rowe objected to setting
trial dates because at that time I was unavailable and incapable of
providing dates of availability.  I understood that there was an agreement
that both sides would coordinate to re-set the schedule with approval from
the court. I have been in discussions with Government counsel to seek
concurrence for a delay until either November or March. The Government could
not agree to any delay.  I will cover the reason for the variance in the two
proposed dates in my motion which I will file tomorrow.  I am writing now,
however, to appraise the court because I know bad news does not get better
with age.  Given the abbreviated time before trial is to commence, I
respectfully request an 802 to discuss this matter as soon as the court is
available.
