RE: Soueid case



Great.  Thanks.  There may be nothing you can do about this but we have known that this was coming.  He has spoken to the FBI and they made it clear that he was being investigated.  He did not flee nor attempted to evade.  My experience is that a warrant is almost always sought in felony cases but detention is only requested when there is a violent crime or flight is possible, not unlike the conditions under R.C.M. 305.  Thank you for the updates.

Liz is trying to reach out to the AUSA on the case to find out, but usually if the individual is arrested (vice summons) then the government will ask for detention.  Since this is just the initial appearance the Judge will set a detention hearing (would most likely be Friday) to argue detention.  If Liz hears back from the AUSA we can get you in touch with him or get you more info.

 

It may be something they ask us to cover anyway, in which case you can let us know a date when you will be available for the detention hearing and we can relay that to the judge.

Wow! Small world.   Great to hear from you Kate.  We’re both doing well. 

Mr. Soueid was arrested yesterday.  I understand that he will be brought to the courthouse today.  I am assuming that he will be in the afternoon session.  Unfortunately neither I nor Mr. Puckett are in town.  He’s in trial and I am in Michigan.  I found out about this last minute.  Do you know if the Government is going to ask that he be detained?

Mr. Faraj –

 

I am one of the other duty SAUSAs this week.  We are checking on whether your client has his Rule 5 today.  It is not currently on the judge’s 2pm docket, but if he was arrested today it is likely that it will be added last minute.  The duty judge today who would be hearing the Rule 5 is Judge Buchanan on the 5th floor.

 

I am leaving the office early b/c I have to take my daughter to the doctor, but if he shows up on the docket Liz will get back to you – otherwise I would just come here in case.

 

I hope you and Mr. Puckett are doing well.
