You have been talking to Elder and believed that you would come to an agreement so you did not follow up on a response. Since then you have filed an answer. Setting aside the judgment does not prejudice Mr. Elder. There are issues in dispute and it is only fair that the case proceed so that the issues related to the claims by Mr. Elder be resolved.
