Matt,
Please share the statement with the prosecutors.  I am not concerned that
Jeremy omitted facts about his participation.  That is not a
misrepresentation, merely an omission.

I have Owens' statement but I did not give it to the Govt yet.  I can do so
you if you recommend that COA.  From the letter he wrote, I wasn't sure that
it said what we wanted it to say since it seems to contradict what was in
the pretext phone call.  His letter says that nothing happened between he
and Klay whereas Jim's phone conversation with Klay seems to say that she
gave Jeremy oral sex.  Again, I will certainly provide the letter to the
Trial Counsel if you would like me to.  I'm completely deferring to you as
Jim Rowe was adamant at his arraignment that he has retained you as his
attorney so I don't want to do anything to violate his atty-client
relationship with you.  Also, Jeremy called Trial Counsel today and stated
that he received the subpoena to attend the deposition.  Would you call him
(I've never spoken to him) and find out what he said to them?  I think they
will accept the statement in lieu of a depo, but I need to be certain that
the letter is GTG before I turn it over.  As far as the Govt is concerned,
until they are satisfied with what Owens will testify to, they are going
forward with the case.  At that point they will be looking for some sort of
low-level forum or admin discharge for Jim.

Matt,
I have done nothing on this matter because I was under the assumption that
it may settle through a plea agreement.  What did the government do with
Owen's statement?  I did not know that the Government had noticed a
deposition of Owens.  I am certainly unavailable on the 15th and frankly
have no idea what is going on with respect to the schedule.  If you believe
that this is going to go forward then I will take a look at the schedule
file a notice of appearance and request a continuance as necessary.

Good morning Haytham,

Just a quick update on Jim Rowe's case:  The Govt sent subpoenas to Jeremy
Owen.  They sent one to his home and one to his office but have not received
any response.  They have also called him to no avail.  The CG's deposition
order states that the depo must be completed no later than 15 September.
Any thoughts?  Also, did you contact Judge Hale and notify the court of your
representation of Jim?  Judge Hale wanted to see that after the arraignment.

Just let me know what you have in mind.
