SSgt Lopez, This was a government offer that was made today. My position has not changed. I feel like this is a winnable case but of course every trial comes with risks. I don't believe they'll take you to an ADSEP but they can if they want to.
Let me know what you'd like to do. Haytham Faraj Sent from my iPhone Begin forwarded message:
Sir, I spoke with Capt White last week because I was unable to get in touch with you. Not sure if he was able to get in touch with you to relay my message. Bottom line is that the command is willing to go the NJP route; pleading should be consistent with the 410, in exchange for SSgt Lopez's proffer against GySgt Kelton. This command is not a fan of last minute deals so if this is amenable to your client please let me know as soon as possible. v/r, Lt McGuire-----Original Message-----From: Haytham Faraj [mailto:haytham@puckettfaraj.com] Sent: Monday, July 18, 2011 3:45To: Mcguire 1stLt Maryann NCc: White Capt Bret ASubject: Re: SSgt LopezLt Mcguire,I am outside the U.S. For the next 7 days. Can this wait or will it disrupt your ability to prep for trial? If you wish you can email me your recommendations which I will discuss with SSgt Lopez then call you to give you our decision. I hope you are enjoying your vacation. At you earliest convenience I would like to discuss a potential alternate disposition for the SSgt Lopez court-martial that may or may not be amenable to your client. If I am not in my office I can be reached on my cell phone at (914)419-7976.
Very Respectfully,
