Dear Lynne, You may release the security deposit to your client in lieu of rent currently due. ÂShould Mr. Lynch discover any discrepancies during the walk through, he should note them and bring them to Mr. Doddâs attention. I have been assured by Mr. Dodd that the house will be ready to be turned over. If it is not, let me know so I can work with you on resolving outstanding issues. Sincerely, Haytham Faraj From: lumulcahy@aol.com [mailto:lumulcahy@aol.com] Haythem, It is my understanding that based on the email exchanges between our respective clients, that you would be holding 1 1/2 months rent as the security deposit with respect to the Lease between Lynch to Dodd. Please see email below. Please confirm that you are holding same. Please also confirm that I am authorized to release the security deposit that I am holding pursuant to the Lease to cover the shortage of your clients rent for May and June, 2011 which he has not paid. I look forward to hearing from you. Lynne U. Mulcahy, Esq. 336 Main Street P.O. Please do not walk on or put anything on the deck until it is complete, the finish should be dry by Wednesday June 22nd but I will let you know when you can walk on it. I would also ask you to cut the grass and maintain the property as agreed upon in the lease. Regarding our latest conversation about the rent money due, I think you should review the lease agreement again, it clearly states that the security deposit cannot be used as payment of rent. You are two months behind in rent payments, can you please pay the amount due so we can move on. Your security deposit will be returned to you after our final walk through on Thursday June 30th at 9:00 am as agreed upon in the lease. Thank you, John Lynch
