Haytham Faraj Sent from my iPhone I think it was Judge Effron being a smart ass asking Keller if he'd prefer to they just leave the error (Hutchins-type) severance in the record so that they could test for prejudice and/or reverse the case on appeal, or whether the trial judge ought to be given the opportunity to remedy it first. Something like that. Dwight suggested we quote that language from the audio of the oral arguments and reference how many minutes into the argument it occurred. The purpose was to highlight that the judges already considered that error was imbedded in the record unless it was cured pretrial. Just recalling Sullivan's suggestion.
