Second loss of counsel motion



I fired off the 1st draft to Babu last night.  He said he should have it back to me by noon today.  Once I have a semi finished product I’ll send it to you for an edit before we fire it off to the judge.  I would like you to think about this motion.  If we prevail we may actually bring back Colby.  That will be very disruptive to his life and his family while our return will be negligible.  You and I are more than capable of doing this case.  In fact, either one of us alone can do this case.  I still want to file it and go through the process but I want us to seriously consider arguing something to the effect that while we’re not waving our client’s right to counsel, we can no longer accept the delays and demand to go to trial.  I thought a lot about how this would affect Colby.  I can’t in good conscience say that the minimal benefit of returning Colby to active duty to assist us even minimally outweighs the massive disruption to his life.
