RE: Trial expenses
No problem with payments. The airline appears to have fucked things up or
my assistant didn't' know what she was doing. I will have her figure out
why we got double charged for one of the tickets.
We didn't really get a chance to talk at the end but I feel really happy
for you. This was a rough three years. At times I was frustrated with you.
Many times I doubted my abilities to make it happen. I lost many nights of
sleep thinking about you going to jail and how I would face your mother.
I've come to a point where the sentence is what matters. I couldn't have
handled seeing you shackled and walking off to the brig. I am happy that
didn't happen. I think this will turn out ok for you. You need to engage
an attorney and send a letter to USD. I have a tenacious friend that is
fearless when it comes to pursing those types of things. He is right in
downtown San Diego. If you like I can connect you with him.
The polygraph is going to cost about $300-$350 at a minimum. Before we do
that why don't you engage your chain command to help you out with getting
the CG to set aside the conviction especially in light of the many bad acts
by Smith?

Haytham,
I've talked to Chris and am working on putting the clemency package
together. I've requested letters of recommendation from: LtCol McCarthy,
LtCol Shaw, Maj Lee, Maj Serano, and LtCol Pauly (AC/S Comptroller, 3d MAW)
(he may or may not based on the limited contact we've had). I plan to go see
the SJA, Col Brubaker, this week informally to discuss the clemency process
in regard to the CG. I will work the formal process through my chain of
command once I have the package complete. I intend to include the copies of
my OMPF (including FitReps), the letters of recommendation, the polygraph
results if they come up in my favor (I'd like to see if there is a
polygrapher who can do it for $150-250), and a letter from me through
counsel (You and/or Chris). Chris has also requested letters from any of the
members as well.
In regard to the $5k, is there a way to work out some type of payment plan?
I will be able to pay it off sooner when Dalliana can get a job, but we are
currently in extreme debt, so any leeway your office can give would be
greatly appreciated. I know and respect the fact that with everything
involved in this case this was a bargain for me on your part, and am very
thankful that you still put in every effort toward my case. Even if nothing
else goes my way, I am extremely grateful to have the sex offenses off my
back.
Let me know if you know any other polygraphers, whether they are local or
not. If there is one on the West Coast, I can probably make it into a family
trip. I will also ask my brother if he or any of his contacts know of any.
I can't express how grateful both I and the rest of my family, particularly
Dalliana and my mother, are to you and Chris for all of your dedication.
Thank you so much. I feel vibrant and know I have a new lease on life, which
I can never fully repay.
I plan to have the formal package ready for review as a working copy by next
week.

Doug,
I just did a rough total of expenses during the last 3 weeks. It came to
just over $5k. There appears to be an airline error of about $500 one of
the billings. I am going to have my assistant square it away. Once it's
finalized and double checked I'll send it to you. I wanted to give you a
heads up.
I hope all's well with you and you had a chance to finally relax this
weekend. I intend to send a letter to Judge Advocate Division raising the
perjury of Smith. I plan to include the contradictory statements she made
and the statements of other witnesses. I recommend you request a meeting
with your SJA and request to see the General yourself. The meeting should
directly address the injustice of the charges and the manipulations that
brought you here. You should of course go through your chain of command. I
can assist with how to address the matters with the CG.
