Re: Scarselli NJP on 3 Dec - advice

I agree that you should begin there alone. O was going to recommend that to you. The statements are fine. You may also choose to call them by telephone and have them testify. Let's chat today or Monday evening about what your statement.

gentlemen, hope you both had a most blessed Thanksgiving with your families.

Few questions:

-I think it best if I am in the office alone with the CG during the NJP.  Thoughts?

-I have emailed 2 GOs and 2 Colonels so far. I will also be emailing my current LtCol and Colonel. Asking all for letters of recommendation.  I have also asked one SgtMaj and one MGySgt.  Do I need more?

-I will have letters from Captains Beck and Knobel, MGySgt Humbertson and former civ Lt, Daly. All of those letters will speak to the specific charges.

-what other documents should be provided to the CG?

-what 3 star will be the final decision maker on the show cause matter?  MARFORPAC or MCCDC?

-I am preparing a letter/statement to the CG as well.  I will send it to you first of course for your review. It will give whatever amplifyingdetails of each charge, as well as any extenuating circumstances and matters for mitigation.  My thought process with that is that the CG will have some time to review that rather than have to hear it for the first time when Im in front of him.  This way he can mull it over rather than try to regiser it all at once.

thats all i have in my brain at the moment.   hoping you both can reply soonest as I continue to prepare.

Thanks and Semper Fidelis!

Sir,

I will be there that day.  I expect Haytham to be there too.  Ordinarily, the defense counsel do not enter the CG's NJP, but we can ask that we be there.

Regarding show cause, it will be the first 3 star in the your chain of command that makes the decision whether you go to a BOI or not.  He will receive a recommendation from his SJA and BGen Clardy regarding whether you go to a BOI or not; but the decision is his alone.

Again, I highly recommend you get together as MANY letters of recommendation as you possibly can between now and 3 December (to prepare a binder for BGen Clardy and the show cause authority to review) and that you also have 3 witnesses to call on your behalf during your NJP.  They should be the most senior people you can get that will say positive things about you.

Christian, thanks for the email.  was hoping you could take a minute and send me an email describing what I should expect at the NJP as far as forum...for example...are you and haythem in there with me the whole time, will Gilinsky be in there? etc  at least from what youve seen in the past, ya know.

Also, what exact office at SecDef (or wherever) makes the decision on whether or not i have to show cause?  Does USMC, JAM play in that call? etc

Thanks.  S/F!  R/ Maj Scarselli
