I have never filed a notice of appearance as civilian
counsel in Wuterich! We have the same case as Hohman, except that while other
detailed counsel chose not to show up in court after release from active duty, which
is probably a violation of their professional responsibility rules, we –Colby
and I- continued to appear. The question that keeps nagging at me is does
the government then get to argue that there is no violation of RCM 505, 506 and
Hutchins because we showed up lest we receive the wrath of our State Bar disciplinary
committees and the live in infamy in appellate court decisions that cast doubt
