Pete,
I am going to resubmit today with the "drunk and disorderly" language.  I
would like to submit with the GCMCA language stating no show cause
recommendation.  I will leave it up to the CA to decide.  I think we all
agree that he should not be separated.  He's at 19 years.  Separation would
be a devastating punishment for this offense even though there is a prior
NJP.  We're willing to work with you to avoid the court-martial.  I
recognize that that is in Maj Rowe's best interest also.  A court-martial
will probably result in a conviction but it will not result in a dismissal.
By the time the court martial is completed, review is done, show cause is
ordered and a BOI is put together, he'll be at 20 years which means you will
have to retire him.  Since we all essentially agree what the ultimate
outcome should be, is there any way to get us there now?  I know all you can
do is recommend and I guess that's all I'm looking for.  I am not going to
reject this deal because the General says no but I would like to see if I
can persuade you to make the recommendation because both you and I agree
where this should go.  Show cause may still be ordered even if the General
doesn't recommend it.  On the other hand, if it is not ordered, we can save
the time that would be required to put on a BOI.

I reviewed the NJP deal.  The following will be the two points of
contention:

1.  If he is only going to accept NJP for one spec of Art 133 it needs to
read:

Violation of Article 133
In that Major Carlos O. Rowe, United States Marine Corps did, at or near
Kansas City, Missouri, on or about 7 November 2009, in a public place, to
wit:  the Marine Corps Ball, become drunk and disorderly while in uniform,
to the disgrace of the armed forces.

2.  The language that the GCMCA recommend no show cause or separation.
