Doug,

Last week the government requested and received a delay in the U.S. v.
Wuterich case over defense objection.  They slid that case into your trial
period and pushed yours back.  My first trial date is February 1, 2011.
That is probably the date you will get when I meet with the judge on the
13th.  The Government has already conceded that all judges on the West Coast
are inextricably conflicted.  They have, or soon will, detail LtCol David
Jones to the case.  His last tour was as RDC.  Don?t get too excited; he?s
not that defense friendly.  He is, in my opinion, one of the best judges on
the circuit however.  I have tried many cases before him and obtained
acquittals, including the Hamdaniya war crimes case, a multiple rape case
and a serious officer misconduct case.  I will also be trying Haditha before
him.  All in all I think that is a positive development.  He is also the one
that shot down my UCI motion about 4 months ago.  

 

 I have mixed feelings about the delay.  I will discuss everything with you
next week.  I would like to meet with you next week.  I can meet you Monday
evening at about 6 pm in North county, on Tuesday in San Diego TBD, or very
early Wednesday morning in North County.  I prefer Monday evening.  I?ll see
if I can convince Chris to join us.
