Guys, I like this motion. It’s an innovative
argument. It has one problem. Anytime an Article 10 violation is
alleged, the parties need to account for the days by using a table to show the important
dates excludable delay and milestones. We don’t have that in this
motion nor do we have the time to do it today. I recommend we hold off on
filing this motion until the next session. In the meantime we should
notify the government that we intend to call Burge, Smith, Brooder, I am
