Hi Lindsay. 
Thanks for sending what you have. I plan to challenge the regulation based on the term "spice" being ambiguous. In my case, the seized substance did not have any of prohibited ingredients listed on the schedule. The charge is based on the accused admitting that it is spice. I may also have a suppression motion for lack of corroboration under MRE 304g but that's an independent issue. I haven't read the attachments you sent yet. I'll be traveling until about 1400 EST.
