Mr. Faraj,

Thanks for the witness request. The discs containing the testimony were mailed via fedex to Capt Hur sometime last week at my direction. You are free to do whatever you desire with the discs, however, our court reporters have entirely too much on their plate with the current caseload including contested cases in progress this week to produce transcriptions of three motions sessions. I would imagine that MCRD has more free personnel.

I'll go through the witness request when I get a few moments today.

I have attached our witness request for the 16 and 17 June 39a. On May 21st we requested a transcript of Capt Gilinskyâs testimony from the last 39a as well as transcripts of all representations made by counsel regarding the Capt Beck matter at that hearing. To date we have not received that transcript. Please let us know the status of that request and as soon as practicable whether the requested witne sses will be produced.
