Let me firm up a date for the 39a. I believe your analysis is right on the
mark with respect to the immigration issue. He doesn't have to be awarded a
BCD to face deportation and the deportation decision is not always made
immediately after a conviction. It can take some time. Professor Muneer
Ahmed at Yale law School can shed more light on this. His expertise is
endorsed by Col Dwight Sullivan at NAMARA.

Thanks. I think we're pretty close. His company commander told me that Cpl
Siddiqi has been doing well since his return from the hospital, and they are
planning on allowing him to take leave to go home for about 10 days.
I know you have been busy, so I asked Alex to put together a written offer
with supporting documents, including a letter from an attorney specializing
in immigration law. Col Perez is under the impression that Cpl Siddiqi will
not face any adverse immigration proceedings based upon a conviction at a
SPCM. My understanding is that even a conviction without a BCD could still
result in deportation, but I want to rely upon an expert's opinion.
Just in case, do we want to schedule a 39a for early June while you are in
the area? Thanks.
