FMLA Forms: Expiration Date Saga
The US Department of Labor (DOL) has submitted the Family and Medical Leave Act (FMLA) forms for renewal by the Office of Management and Budget (OMB). The most recent versions originally expired on December 31, 2011. On Saturday January 14, the DOL quietly changed the expiration date on the FMLA forms to January 31, 2012; however, this appears to be the only change at this time. As always, employers should use the most recent versions of the forms; however, be reminded that the DOL forms that expire on January 31 do not address the Genetic Information Nondiscrimination Act (GINA) safe harbor notice employers can provide when seeking medical information from employees or employees’ medical providers. We provide articles, information on the GINA safe harbor notice and links to the most recent versions of the FMLA forms.

Wellness Programs & Nondiscrimination
An employer-provided wellness program raises potential discrimination issues under a myriad of laws, primarily: the Health Insurance Portability and Accountability Act (HIPAA) nondiscrimination rules, the Americans with Disabilities Act (ADA), the Genetic Information Nondiscrimination Act (GINA).

Healthy Food at Work
We provide resources to assist employers in bringing healthier foods and beverages to their workplaces’ meetings, vending machines, lunch room and cafeteria.

Encouraging Physical Activity
By encouraging employees to be more physically active —on breaks, at lunch, before or after work—HR can help them become more fit. Walking outside or in the hallways, or using the stairs instead of elevators, are small efforts that make a big difference. The specific activity is not important. What matters is getting people up and moving.
